TikTok, Meta Drags European Union To Court Over Fees
In a major legal development, TikTok and Meta Platforms Inc., led by Zhang Yiming and Mark Zuckerberg, respectively, have initiated legal proceedings against European Union regulators.
The companies allege that they are shouldering an unjustly heavy financial burden compared to competitors due to fees related to the EU’s content moderation rules.
TikTok and Meta contended that the fees imposed on them are disproportionate, questioning the European Union’s methodology in calculating charges.
They argued that flawed third-party estimates of user numbers are influencing the fees and are pushing for a fair evaluation of the imposed financial obligations.
The dispute centres around the EU’s Digital Services Act, which mandates social media companies to intensify moderation efforts and implement measures against harmful content.
Additionally, online marketplaces must identify sellers, and non-compliance may result in fines or expulsion from the EU.
The EU categorized companies as “very large online platforms” if they exceed 45 million monthly active users in Europe.
Such platforms are required to share enforcement costs based on user numbers.
This designation has prompted TikTok and Meta to challenge the fairness of the fee distribution.
The European Union staunchly defended its decision, asserting the solidity of its methodology.
The EU vowed to uphold its stance in court, maintaining that all concerned tech firms fulfilled their fee obligations by the designated deadline in December.
While Meta expressed support for the objectives of the new rules, it criticized the methodology employed.
Meta argued that companies incurring losses are exempt from payment, leading to what they deem an inequitable distribution of fees among companies.
