Ojike, through his counsel, Reuben Atabo (SAN), is challenging the declaration of Kosisochukwu Ibemesi as the winner of the APGA primary conducted on May 23.
In the suit marked FHC/AWK/CS/173/2026, Ojike contended that he secured the highest number of valid votes cast during the exercise and should have been recognised as the party’s authentic candidate.
The lawmaker, who currently represents Oyi Constituency in the Anambra State House of Assembly, joined Ibemesi and INEC as defendants in the matter.
According to the court filings submitted on June 4, Ojike is seeking 12 reliefs, insisting that he polled 3,524 lawful votes and was duly returned as the winner of the primary election by the recognised Returning Officer, Dr. Nnewaluem James.
He claimed that he scored the highest number of lawful votes cast of 3,524 and was duly declared and returned as winner of the Oyi State Constituency Primary Election on May 23 by the legally recognisable Returning Officer, Dr Nnewaluem James.
He said that he was the rightful and lawful candidate of the 2nd defendant (APGA) for the general elections.”
The plaintiff argued that his position aligns with the provisions of Section 84(1) of the Electoral Act, 2026.
Among the orders sought, Ojike asked the court for “an order nullifying or setting aside the purported declaration made on the 25th day of May, 2026, by the 2nd defendant (APGA) of the 1st defendant (Ibemesi)’s name as winner of the Primary Election for the Oyi State Constituency.”
He further urged the court to compel APGA to immediately forward his name to INEC and direct the electoral body to accept, publish and recognise him as the party’s candidate for the Oyi Constituency seat in the 2027 general election.
In addition, the aggrieved aspirant is demanding N100 million in exemplary damages against APGA and Ibemesi, as well as another N100 million to cover the cost of litigation.
As of the time of filing this report, the case had not been assigned to any judge.
