Think Before You Post: Social Media Etiquettes

Under the Nigerian Cybercrime (Prohibition, Prevention, etc.) Act, 2015, individuals can face legal consequences for posting offensive or defamatory content on social media platforms like Facebook.

Specific Sections:
1. Section 24: Cyberstalking/Cyberbullying – 2-5 years imprisonment and/or ₦2-10 million fine.
2. Section 26: Sending threatening or offensive messages – 2-5 years imprisonment and/or ₦2-10 million fine.
3. Section 38: Phishing (includes online impersonation) – 3-5 years imprisonment and/or ₦3-10 million fine.
Defamation: Section 373 of the Criminal Code Act, Cap C38, Laws of the Federation of Nigeria, 2004 – Defamation is punishable by up to 2 years imprisonment.
Examples of offensive posts that may lead to charges:
1. Hate speech
2. Ethnic or religious intolerance
3. Threats or incitement to violence
4. Harassment or bullying
5. Defamatory statements
6. Obscene or indecent content.

The Cybercrime (Prohibition, Prevention, etc.) Act, 2015, is a federal law in Nigeria that prohibits and punishes various cybercrime offenses. Here are some of the offenses under the Act:

1. Cyberstalking (Section 24): 2-5 years imprisonment and/or ₦2-10 million fine.

8. Online fraud (Section 37): 5-10 years imprisonment and/or ₦5-20 million fine.

9. Phishing (Section 38): 3-5 years imprisonment and/or ₦3-10 million fine.

10. Spamming (Section 39): 1-3 years imprisonment and/or ₦1-5 million fine.

11. Cyber-terrorism (Section 40): Life imprisonment.

12. Child pornography (Section 23): 10-20 years imprisonment and/or ₦10-50 million fine.

13. Online intellectual property infringement (Section 34): 2-5 years imprisonment and/or ₦2-10 million fine.

1. Interception of electronic communications (Section 41).

2. Disclosure of electronic communications (Section 42).

3. Retention of traffic data (Section 43).

4. Cooperation with foreign governments (Section 44).

Regulatory bodies:

1. National Information Technology Development Agency (NITDA).

2. Nigerian Communications Commission (NCC).

3. Economic and Financial Crimes Commission (EFCC).

– Avoid spreading misinformation

– Refrain from hate speech or harmful content

– Respect others’ opinions and privacy

– Be cautious of online scams and phishing

– Consider your employer’s social media policies.

– Verify information before sharing

– Use respectful language

– Keep personal and professional life separate

– Report suspicious or harmful content
