The Federal Competition and Consumer Protection Commission (FCCPC) has reacted to WhatsApp’s claim that it might be forced to exit Nigeria due to the recent $220 million fine and additional demands.
The FCCPC posted a statement on Twitter on Thursday night, addressing the situation.
In their statement, the FCCPC said that WhatsApp’s announcement might be a strategic move to influence public opinion and pressure the commission to reconsider its decision.
The background to this issue began when the FCCPC investigated Meta Platforms and WhatsApp for allegedly violating the Federal Competition and Consumer Protection Act (FCCPA) and the Nigeria Data Protection Regulation (NDPR).
The investigation found that Meta and WhatsApp committed multiple and repeated infringements of these laws.
These included denying Nigerians the right to control their personal data, unauthorized transferring and sharing of user data, discriminating against Nigerian users compared to those in other regions, and abusing their dominant market position by enforcing unfair privacy policies.
As a result, the FCCPC issued a final order requiring Meta and WhatsApp to comply with Nigerian law, stop exploiting Nigerian consumers, change their practices to align with Nigerian standards, and respect consumer rights.
To ensure accountability and deter future violations, the FCCPC imposed a $220 million fine.
Whatsapp however vowed to appeal the fine.
The FCCPC said that their actions are based on legitimate concerns about consumer protection and data privacy.
They view the order as a positive step towards a fairer digital market in Nigeria.
The commission noted that similar measures are taken in other jurisdictions without forcing companies to leave the market, and they believe the situation in Nigeria should be no different.
