Court validates prosecution of suspended Adamawa REC

 A Federal High Court in Abuja on Friday struck out the application filed by the All Progressives Congress governorship candidate in Adamawa State, Senator Aisha Binani Dahiru, praying to halt prosecution of Hudu Yunusa-Ari, the suspended Adamawa Resident Electoral Commissioner.
Hudu who unlawfully announced Binani as the winner of the governorship election in the last gubernatorial election in Adamawa State.
 Meanwhile, it should be recalled the Independent National Electoral Commission (INEC) annulled the declaration and installed the incumbent governor, Umar Fintiri.
  Subsequently, INEC filed a six-count charge against the ousted REC at the Adamawa State High Court in Yola.
However, Binani prayed the court to stop the parties in the interim so that INEC could show cause why Yunusa-Ari, her top witness at the Adamawa gubernatorial election tribunal, should be prosecuted when the proceeding was ongoing.
 Justice Donatus U. Okorowo however lifted the interim order, saying, “There is no order of this court extending the lifespan of this order on status quo.”
 Okorowo also ruled that it was not appropriate under the law for a plaintiff to seek  the intervention of Federal High Court to stop the proceedings at a court of coordinate jurisdiction.
