Appeal Court Upholds PDP Federal Lawmaker’s Election


The Court of Appeal sitting in Akure has validated the decision of the Ondo State Election Petition Tribunal that upheld the election of a member of the House of Representatives from Okitipupa/Irele Federal Constituency, Prince Mike Omogbehin of the Peoples Democratic Party (PDP).

The action of the court, led by Justice Muheed Owoade, was sequel to the dismissal of  an appeal filed by Mr. Victor Akinmoyero of the All Progressives Congress (APC) for his failure to tender credible documentary evidence to back his case.

Owoaade held that the appellant only tendered hear-say evidence and also failed to call enough witnesses to prove his allegations of over voting and other electoral irregularities in March 28 election.

The three man appellate court said the PDP lawmaker was duly elected.

The court awarded  thirty thousand naira cost against the appellant.

Reacting, the APC counsel, Dr Tunji Abayomi expressed sadness over the verdict while the PDP lawyer Mr Remi Olatubora described the court’s decision as a true reflection of the law.
