Abuja Court Strikes out Cheating, Breach of Trust Charges Against Businessman after Settlement

A Life Camp Magistrates’ Court in Abuja has struck out charges of breach of trust and cheating filed against businessman Afolabi Olajide after both parties reached an out-of-court settlement.

Magistrate Hauwa Aboki discharged the defendant following an application by the defendant’s counsel, Lillian Ibrahim, who informed the court that the complainant had settled the dispute and was no longer interested in pursuing the case.

The defense urged the court to strike out the matter on the grounds that both parties had amicably resolved the dispute outside court.

Ruling on the application, Magistrate Aboki said:

“Having heard the defense application, the case, as a result of lack of interest and the settlement reached by both parties, is hereby struck out.”

The court subsequently struck out the First Information Report (FIR) filed against Olajide.

According to the charge, Olajide, a resident of New Nyanya, Abuja, was accused of breach of trust and cheating in connection with the sale of a vehicle.

The FIR alleged that on October 7, 2024, the complainant entrusted him with a Honda Accord to sell for ₦2.2 million.

However, Olajide allegedly sold the vehicle to Innocent Onuh for ₦1.4 million and converted the proceeds to his personal use.

Police further alleged that, during the investigation, the defendant made a confession admitting to the offense.

The alleged offenses were said to contravene Sections 312 and 322 of the Penal Code.
