Abuja Court Strikes Out Assault, Theft Case After Parties Reach Settlement

A Magistrates’ Court sitting in Life Camp, Abuja, on Wednesday struck out a case of alleged grievous hurt and theft filed against three men after both parties reached an amicable settlement.

The defendants—Idris Isah, Janaidu Suleman and Sani Adamu—were discharged by Magistrate Best Ojukwu, who approved the settlement reached between them and the complainant.

Both the complainant and the defendants were present in court.

Delivering her ruling, the magistrate said the parties had agreed that the defendants would pay the complainant N70,000 and also sign a written undertaking to maintain good conduct.

“Having heard the defendants’ and the complainant’s side of the story, both parties agreed to a payment of N70,000 to the complainant and a written undertaking by the defendants. The case is hereby struck out,” Ojukwu ruled.

Following the agreement, the court struck out the First Information Report (FIR) filed against the defendants and warned them against engaging in any criminal activity in the future.

Earlier, the prosecution counsel, Charity Nwachukwu, told the court that the complainant, Okon Archibong, reported the matter at the Jabi Police Station on June 26.

She alleged that the defendants attacked Archibong with a wooden log during a dispute over a minor issue, inflicting injuries on him.

The prosecutor added that during the altercation, the complainant allegedly stabbed the second defendant, Janaidu Suleman, on his right hand with a key-holder knife in self-defense.

Nwachukwu further told the court that the complainant’s Samsung mobile phone was stolen during the incident.

According to the prosecution, police investigations revealed that the defendants made confessional statements admitting to the offenses.

The alleged offenses contravened Sections 243 and 287 of the Penal Code Law.
