Fresh Setback for David Mark-Led ADC as Court Adjourns Leadership Suit

The Federal High Court in Abuja has adjourned until September 28 a suit seeking to restrain the David Mark-led leadership of the African Democratic Congress (ADC) from parading themselves as leaders of the party.

The suit was filed by an aggrieved ADC member, Nafiu-Bala Gombe.

The case, which was scheduled for the hearing of pending applications on Monday, could not proceed because the presiding judge, Justice Peter Lifu, was not in court.

The matter was subsequently adjourned to September 28.

The News Agency of Nigeria reports that Justice Lifu had on June 16 fixed the case for hearing after dismissing an application seeking his recusal from the suit.

The judge ruled that two separate motions filed by the ADC and its National Secretary, Ogbeni Rauf Aregbesola, lacked merit and awarded N1 million costs against each defendant in favour of Gombe.

The ADC and Aregbesola had asked Justice Lifu to withdraw from the case, alleging bias.

In the suit marked FHC/ABJ/CS/1819/2025, Gombe is seeking an order restraining Mark, Aregbesola and members of their interim National Working Committee from presenting themselves as leaders of the party.

He argued that their emergence violated provisions of the ADC constitution and the Electoral Act.

Gombe listed the ADC, Mark, Aregbesola, the Independent National Electoral Commission (INEC) and Ralph Nwosu as the first to fifth defendants respectively.

Nwosu is the former ADC National Chairman who stepped down to pave the way for the emergence of the David Mark-led leadership.
