A Federal High Court in Abuja has dismissed a suit challenging the emergence of former Attorney General of the Federation, Abubakar Malami, as the African Democratic Congress (ADC) governorship candidate for Kebbi State.
Delivering judgment on Tuesday, Justice M. G. Umar ruled that the plaintiff, Abdulrazak Isa Iko, failed to establish that he participated in the party’s primary election and therefore lacked the legal standing to challenge the outcome.
The court held that the suit lacked merit and substance, having resolved the issue of locus standi against the plaintiff, and consequently dismissed the case in its entirety.
The judgment clears a major legal hurdle for Malami, allowing his candidacy to stand ahead of the governorship election.
The court also reaffirmed the long-established legal principle that only individuals with the requisite legal standing can competently challenge the conduct of a political party’s primary election
