Malami Asks Court to Vacate Interim Forfeiture Order on Three Properties

Former Attorney General of the Federation, Abubakar Malami (SAN), has asked the Abuja Division of the Federal High Court to set aside the interim forfeiture order placed on three properties by the Economic and Financial Crimes Commission (EFCC).

Malami is challenging the inclusion of the properties located in Kano and Abuja among 57 assets temporarily forfeited on January 6, 2026, on grounds that they were lawfully acquired and duly declared in his asset declaration forms submitted to the Code of Conduct Bureau in 2019 and 2023.

In a motion filed by his legal team led by Joseph Daudu (SAN), Malami accused the EFCC of suppressing material facts and misrepresenting information to obtain the ex parte order.

He argued that the properties are not linked to any unlawful activity and that one of them is held in trust for his late father’s estate.

Malami urged the court to vacate the interim order and restrain the EFCC from interfering with his ownership, describing the action as a violation of his fundamental rights and presumption of innocence.

The case has been returned to the Chief Judge for reassignment after it could not proceed on the last adjourned date.
