BREAKING: Nnamdi Kanu to Stand Trial as Supreme Court Reverses Appeal Court’s Rulin

The Supreme Court ruled that even though the Nigerian Government acted recklessly and unlawfully in bringing Nnamdi Kanu from Kenya, this wrongful act doesn’t stop any court from continuing with his trial.

Recently, the Supreme Court overturned a decision by the Appeal Court that had declared Nnamdi Kanu, the leader of the Indigenous People of Biafra, not guilty. The Appeal Court had previously acquitted Kanu based on the circumstances of his return to Nigeria.

In their ruling today, Friday, December 15, 2023, the Supreme Court supported the Federal Government’s appeal, which opposed the Appeal Court’s decision to dismiss the charges against Nnamdi Kanu, as reported by Channels Television.

The Supreme Court emphasized that Kanu must now undergo trial at the Federal High Court. Justices Garba Lawal and Emmanuel Agim, delivering the judgment, criticized the Court of Appeal for incorrectly asserting that Kanu couldn’t be retried due to the government’s illegal actions during the invasion of his home.

Following this, the Apex court accepted the Federal Government’s appeal and rejected Kanu’s cross appeal.

The Supreme Court reiterated that despite the government’s reckless and unlawful actions in rendering Kanu from Kenya, it doesn’t prevent any court from proceeding with the trial.

Justice Lawal pointed out that the suit seeking Kanu’s release didn’t cite any Nigerian law regarding his mere unlawful abduction from Kenya.

He added that the appropriate remedy, at the moment, is for Kanu to file a civil matter against such actions, rather than stripping the courts of their powers to continue with his trial on alleged criminal charges.
